no, the penalty for the crime is the risk. not the likelihood of being caught. for example stealing a candy from a store is low risk (misdemeanor shoplifting), and medium likelihood of being caught depending on the store. however stealing a car is high risk (grand theft auto, felony) but the likelihood of being caught is low depending on where u steal a car. the risk of wire fraud is high because of felony offense, but it's low likelihood of being caught, also depending on what u wire fraud and who u fraud it from

Risk only means the probability of a negative outcome. And if the probability is low, and the consequences aren't bad, even using your logic, it's not a high risk. So I suppose I'm still not wrong.
