I'm not a lawyer or anything, but because he owns the site and he's using it against the law(selling stolen goods) he could get in trouble.

It would be a similar situation for torrents, If you upload a torrent, you can get in a lot more trouble then if you were to host a torrenting server. The reasoning behind why you don't get in trouble for hosting a torrenting server, is because you're solely a platform for people to distribute things, nothing more, nothing less.
