Apparently, you don't need to have Kinect on all the time. You can turn Kinect completely off on the privacy settings. Source.
And you don't have to pay extra for used games. They'll perform regular online checks to verify disc authenticity. If you sell or trade your game, the new owner will have the game license and former owner can't play from that license. Source.

It says nothing about turning it completely off via privacy settings. It can be turned off by unplugging it, which doesn't change the fact that it's always on when you're gaming. If it really was in the privacy settings, why require it always be connected to begin with?
The "used game" functionality sounds like bullshit to me. Not the entire thing, but the specifics. It wouldn't have been included if it was just simply for nothing, the disc already acts as an anti-pirating feature. It's probably free, but for a limited set amount of times or something like that. Maybe I'm wrong, but considering all the anti consumer shit already in place on the Xbox, I have no reason to give M$ the benefit of the doubt.
