well, if you agree to the terms of service, its not illegal, because you agreed to it, thus nullifying the illegalization of the terms.

To put it basically, if its illegal, but you lawfully agree to it, you cannot really count it as illegal.

The TOS is essentially a contract. A contract that is for an illegal act is void as you cannot have a legal contract for an illegal act. So despite Nexon putting it in the TOS they cannot feign innocence and say that we "agreed" to it.

Also I seem to remember something a few years ago where things like the EULA and TOS were not binding contracts because the courts recognized that people never actually read them...
