Not necessarily, because they put these things into the TOS then it becomes legal for them to do them. If they weren't in the TOS it would be illegal

Well yes and no, its not technically illegal to do it but i think they could be sued for it if they didn't put it in their ToS so their protecting themselves by putting it in their ToS but you do make a good point which i cant give you a positive yes or no answer too.

I Would be interested in how it goes
i was learning about contracts etc in class the other day and this came up and we were talking about how a Contract can't be Vaild if it involves an illegal activity
and this is clearly illegal therefore making the contract void
