I'm a senior advisor right now. It's okay, but I deal with this shit everyday... If they get the old ipod back and test the battery and it comes back fine, they'll charge you for the ipod. And they'll only exchange it for another first gen ipod nano. They have a inventory for the replacements

and you can put any music on the new ipod nanos. Doesn't matter if it's "illegally" downloaded
