Question regarding external overlay cheats

I was wondering if you can get banned for using external overlay cheats.

For instance, if I were to make an external esp that only reads memory but doesn't write to it, then draws the esp (wallhack) on a transparent window that overlaps the BF3 window is there a chance of getting banned or is this considered safe to do?

Treyarch Anti-Cheat on Black Ops 2 apparently is able to detect this, but is Punkbuster able to do so as well?

i know a guy did this around release of bf3 and his cheat got detected so i would say yes. Im pming you a link to the thread with the cheat

Did it get detected because the cheat was public or did it get detected because Punkbuster performs certain checks to see if external overlays are running on the computer?

public combined with them detecting it. most of the time aslong as you don't steal code from pub forums and you keep your hack to yourself it's very hard to get banned by pb

Punkbuster also makes screenshots, the external overlay is visible on that screenshot unless you have a PBSS blocker.
