You should be fine, don't worry to much brother.
Refund it first before turning it on. I know that is what is told by Apple refunders so I assume there's a way to tell when a device is activated, and if Apple does it I don't see why Microsoft wouldn't. Better to be safe than sorry, you've lived your whole life without that Surface Pro, you can go another 1-2 weeks while your refund is processing.

Be on the safer side and turn it on AFTER you get your money back
Wait until refund confirmation that's what I've been telling my customers and I'm in the process of doing like 2 or 3 surface pros.
