When something like gay marriage becomes legal across all the states, it's not a magical unicorn excrementing a piece of legislation. First someone must have their rights violated (in this case fundamental rights). Then an argument must be presented to the courts why this was in violation of their rights. (Right to marriage) Once the argument is made depending on many different issues it may be taken through the courts (district court, then circuit court, and finally the supreme court). In the case of gay marriage, the fundamental right to marriage was guaranteed to all homosexuals within the United States.
