It'd definitely cause a bottleneck, not sure if it would be minor or a massive one though.

That wouldn't fair too well with the 770 being on the higher end scale and the CPU being on the lower end scale. I'd upgrade the CPU first to maybe a 3570k, 4670k or the 4770k. Maybe the 8350 if your on a tight budget.

My bro has a 4670k , but only 4gb of ram and he doesn't use that pc would that be better with the 770?

Yeah that'd be fine, the RAM doesn't usually affect much.

Ya its the same max means you turned all the setting on the game up to the highest possible why ? are you thinking about getting a 650ti ?
