Titan, I'm pretty sure they are, and this happens with all new games. There's no actual deterrent against it, so it'll keep happening.

People usually jailbreak their PS3s or JTAG Xboxs to play these games, since it's kinda the only way TO play the game.

Happens all the time with games, a friend of mine has a Jailbroken PS3 and he gets all his games for free weeks or even months before release. This kind of thing has been going on for a long time, kind of makes me want to invest into jailbreaking my PS3.
