Talk to your lawyer? I don't know about Germany but in the US lawyers cost much more than 400$ to make a case.

Yes, people will buy banned consoles. Most of the time to fuck with the firmware and see if they can get some unapproved files running. OR they could buy it for repairs. Either way you won't get no $400 from it.
