Well if it's for the same price I think it's ethical okay, but illegal because you're scamming...
If I would have a chance to do it, I would scam him back, your just getting your money back.
About the tag:
Donator tag is Premium tag. They've changed it. Premium tag was Donator tag some time ago.

No to the donator one, I think that scamming a scammer for the same amount or less to get the value back tot he victim is alright but some consider it as being wrong
As far as i know, you can scam a scammer as long as your not in any staff positions.

i'm pretty sure you're allowed to scam a scammer if they scammed you. i would assume if you're scamming someone who's ATTEMPTING to scam, then you would be the scammer. and i'm pretty sure the donator tag was for people who donated back then.
