I don't even know anyone who got level 40, but I'm going to guess yes. It's said that getting 40 will take an extremely long time.
If youy played legit and didnt use any hacking tool or programs then they not banned but for the most part they probably are banned
i was level 39 before the waving ban. my account still running around 4 am that night. and i wake up at 8 am. got banned.
