That's incorrect, you do not suddenly lose your statutory rights to return an item if you have failed a refund.

This. You have 30 days to send it back Refund takes 1-3 weeks that's the max you have to wait if doesn't work you can send back without any problems

Doesn't seem like any big risk if the refund fails

Yep, there isn't really any risk tbh. Also, on the Apple website it says you only have 14 days to return it but again, this is superseded by your rights as a consumer to 30 days. Just don't open it until it's confirmed!
