EA facing lawsuit over Battlefield 3 (sort of)
EA are facing a class action lawsuit being brought on behalf of PS3 Battlefield 3 purchasers. This is not the first instance flack surrounding this FPS title but the lawsuit that has been filed by legal firm Edelson McGuire hinges on a promise EA made of a free copy of Battlefield 1943 for each person who picked up BF 3 on Sony’s console.
The class action suit is apparently more about how Electronic Arts notified PS3 gamers that they would not be getting the free title rather than how EA failed to deliver on their promise. The announcement that PS3 owners would not be getting Battlefield 1943 was only made after Battlefield 3 went on sale and was only done via Twitter, meaning that large numbers of customers probably never had a clue. The suit says that EA “misled and profited from thousands of their customers by making a promise that they could not, and never intended, to keep“.
The lawyers involved in the suit have apparently told Kotaku that all the folks involved in the suit want is their promised copy of Battlefield 1943.
