It's possible that Installous wouldn't break the DMCA, considering that the modified firmware is already circumnavigating the encrypted firmware on the flashchip It all depends on how Apple setup their copyright

I'm pretty sure no exception to the DMCA was made to allow normal users to illegal obtain paid applications ...

You never know, they add new loopholes every three years If someone convinced the courts that it's for an educational standpoint it could hold. Installous itself isn't illegal though. It's doesn't crack the apps, isn't there another app that takes paid apps, cracks them, and puts them on installous? That one would be the one to get charged
