It depends on the game and the TOS. The account is most likely intellectual property of the developer, the only way you could become the victim of a lawsuit is if it directly affects the publisher of the game.

Nope, in the ToS of most of FPS games, selling\trade\buying account isn't allowed. (nothing can be happened)
That would be like suing a drug dealer because he ran off with your money or smth.
