No it's not. Most common reason for untrusted is a poorly written aimbot.

Do you have to be in a game in order to get VAC? Or will it VAC you even if you aren't currently in a game.

You can be VAC'd, even, if you used a hack several weeks before. So, yeah, you can receive a VAC ban, even if you're not currently ingame.
