If I scam a scammer, am I scammer?

No, unless someone who scammed a scammer scams someone who also scammed a scammer and then scams the shit out of the scammers who scammed the scammer then he is actually a scammer.

Depends on how it's carried out. Say some guy was trying to fist fight you and you pull out a 12-Gauge shotgun on the dude and he's un-armed and then shoot him, I'm pretty sure it wouldn't end well for you in court.
