Trackers monitor how much of a torrent you have DL'd and UL'd also many ISP's keep a history of the sites you've visited so they don't necessarily need your computer. If they get far enough into court that they DO obtain a warrant for your computer then they can still get at a majority of your information unless you've physically destroyed the information (fire and whatnot)
