PollIs it right for Man 2 to refuse?

Please read and answer:

Two fairly nice men, man 1 and man 2, decided to make an agreement. Man 1 wants an expensive product, Man 2 wants items that would equal the expensive product, but Man 2 would buy the expensive product on Christmas.

Man 1 has found some items that would partially equal the expensive product, Man 2 wants the items right now instead of waiting for Christmas. Man 1 gives him the items.

Man 1 did not explain the items were for the product, therefore Man 2 thought the items were for free (OH NO!).

Man 1 wants the items back OR wants transfer the items into our agreement we made earlier.

Man 2's Decision: Man 2 would do what Man 1 has want/asked or refuse.

The Problem: Man 2 refuses to return the items AND to not transfer the items due to their misunderstandings.



Should Man 2 give back the items? Vote in poll.

Extra question (NOT INCLUDED IN POLL): Is Man 2's refuse make him a scammer? @Jigsaw Correct me if I made any mistakes.

Why is that? Shouldn't the items be given back so they can reset theirs thoughts?

No because the agreement said for Christmas and he didn't wait till Christmas .

What?

Man 2 would give the product at Christmas. They never agreed about the items of Man 1...

To prove that Man 2 should give Man 1's items back.
Obviously #1's fault, as he did not specify that he was giving his items to #2 now instead of christmas.

@Heartview @KABLE Man 1 did specify about giving the items now and Man 2 agreed, he just didn't specify that the items were for the product. Anyways, should Man 2 give back the items?
Was it right != he has the right. He has the right.
It's not MORALLY correct for him to not give back the items but he does have the right to keep them. Let's say I gave some arbitrary (random) person on MPGH $10 one day and then say, "Hey, arbitrary person! Remember those $10 I gave you? I want them back." I can't except said person to give my money back. He didn't ask for them nor did he say that he was going to pay me back for them. The point is, Person 2 said that he would buy the items during Christmas. Person 1 should have waited. It's Person 1's fault.
